1. Identity of the Trader

2. Applicability
These general terms and conditions apply to every offer made by Madamor and to every distance contract concluded between Madamor and the consumer. Deviations from these terms and conditions are only valid if agreed in writing between the parties.
3. The Offer
All offers made by Madamor are without obligation. We reserve the right to change or adjust the offer. Products are described and displayed as accurately as possible; however, colours in images may differ from reality.
Each offer clearly states:
- The price including VAT
- Whether shipping costs apply
- How the agreement is concluded
- Which payment and delivery methods are available
- Whether the right of withdrawal applies.
Obvious mistakes or errors in the offer are not binding on Madamor.
4. The Agreement
The agreement is concluded at the moment the consumer has accepted the offer and met the stated conditions. Madamor confirms receipt of the order by email.
We reserve the right to investigate, within legal frameworks, whether the consumer is able to meet their payment obligations, or whether there are circumstances that prevent the responsible conclusion of the agreement. If there are justified reasons to do so, Madamor may refuse an order or attach special conditions to its execution.
5. Price and Payment
All prices in the webshop are stated in euros and include 21% VAT. Payment is possible via the payment methods listed on the website, including Maestro, Mastercard, Visa, Klarna, Google Pay, Apple Pay, Bancontact and iDEAL (Wero).
After placing an order, the consumer will receive a confirmation by email. In the case of prepayment, delivery will only take place after the full amount has been received. Products remain the property of Madamor until full payment has been received.
Discount codes and vouchers are only valid during the stated validity period and cannot be exchanged for cash.
6. Delivery and Fulfilment
Madamor takes the utmost care in fulfilling orders. Delivery takes place to the address provided by the consumer when placing the order. Orders are typically processed and shipped within one to three business days.
If delivery is delayed or can only be partially fulfilled, the consumer will be notified within thirty days. In that case, the consumer has the right to dissolve the agreement free of charge and receive a full refund.
Once the order has been shipped, the consumer will receive a track and trace code to follow the shipment.
7. Right of Withdrawal and Returns
For distance purchases, the consumer has the right to dissolve the agreement within fourteen days of receiving the product without giving any reason. Within this period, the product may be assessed as it would be in a physical store.
To exercise this right, the consumer can contact us via support@madamor.com or use the model withdrawal form available on our website. After registering the return, the consumer has a further fourteen days to actually return the product.
The product must be returned unused and, where reasonably possible, in its original condition and packaging. The consumer is solely liable for any diminution in value resulting from use that goes beyond what is necessary to establish the nature, characteristics and functioning of the product.
Return costs are at the expense of the consumer, unless the product is defective or incorrectly delivered. Exceptions to the right of withdrawal, such as hygiene products or custom-made items, are clearly stated with the relevant offer and apply in accordance with Article 6:230p of the Dutch Civil Code.
Within fourteen days of receipt of the return shipment, Madamor will refund the full purchase amount, including any standard outbound shipping costs. Refunds will be made via the same payment method as used for the original payment.
8. Warranty and Conformity
Madamor guarantees that products conform to the agreement, to the specifications in the offer, and to reasonable standards of quality and usability. The statutory warranty applies, meaning that a product must meet what the consumer may reasonably expect of it. Any additional warranties do not affect the statutory rights of the consumer.
9. Complaints
Complaints can be submitted via support@madamor.com, stating the order number and a clear description of the complaint. Madamor will respond to complaints within fourteen days of receipt.
If a complaint requires more processing time, the consumer will receive a message within fourteen days indicating the timeframe within which a more detailed response can be expected.
If a complaint cannot be resolved by mutual agreement, the consumer may submit the dispute to the Stichting Geschillencommissie Webshop or to the competent court.
10. Liability
Madamor is not liable for indirect damages, such as consequential damages, loss of profit or missed savings. Madamor's liability is in all cases limited to the amount paid out by the liability insurance or, in the absence of coverage, to the invoice amount of the relevant order.
11. Force Majeure
Force majeure is understood to mean any circumstance beyond the control of Madamor that wholly or partially prevents the fulfilment of obligations towards the consumer. During a period of force majeure, Madamor's obligations are suspended.
If the force majeure situation lasts longer than thirty days, both parties are entitled to dissolve the agreement without any obligation to pay compensation.
12. Privacy
Madamor processes personal data in accordance with the General Data Protection Regulation (GDPR). Our privacy statement, available on our website, describes which data is collected, for what purposes it is used, and what rights the consumer has regarding their personal data.
13. Applicable Law and Disputes
These general terms and conditions and all agreements between Madamor and the consumer are governed by Dutch law. If the consumer resides in another member state of the European Union, the mandatory provisions of the law of that member state may also apply.
Disputes arising from this agreement will, to the extent permitted by law, be submitted to the competent court in the district of Limburg, the Netherlands. This does not affect the right of the consumer to submit a dispute to the court in their own place of residence, if the consumer law of the relevant member state so requires.
